Divorce

Many of our clients' first contact with us is about a divorce.  Usually our clients do want a divorce, but they also need a property settlement and arrangements for their children resolved.  They often also need some assistance with child support and may also need us to help them with immediate financial issues.

A divorce is simply a legal severance of a marriage.  You can apply for a divorce if you and your spouse have been separated for 12 months.  A divorce has the following consequences:

  1. It allows the parties to re-marry;
  2. it starts a time limit within which property matters must be resolved (12 months from the date the divorce is finalised);
  3. It may have an effect on your Will, Power of Attorney, beneficiary nominations for superannuation funds etc if you still have your spouse named in those documents.
