Experience
Jon is joint Managing Partner of the firm and leads our Corporate+Commercial team. He has been a Partner of Hemming+Hart since 1999.
Jon has extensive experience in advising clients on all aspects of commercial activities with a particular focus on acquisitions and structuring.
Jon also practices in Commercial Litigation which has proved to be useful experience when commercial contracts and other transactions do not proceed according to plan.
Recent Matters
- Successfully defending a $100 million damages claim for misuse of intellectual property;
- Pursuing and defending contract disputes
- Pursuing a local Council for negligence and misleading and deceptive conduct on behalf of a land owner;
- Defending a prolongation and quantum merit claim by a subcontractor against a property developer;
- Defending a number of inter-related companies and their directors against a claim by a mortgagor for breach of a mortgage and acceleration of mortgages claim;
- Acting on behalf of a customer against a manufacturer for breach of contract, misleading and deceptive conduct and faulty goods;
- Assisting listed and private companies to recover outstanding debts from customers;
- Defending an unfair preference action against a liquidator;
- Advising companies in relation to defamatory comments made by current and former employees and business competitors in various public forums;
- Applying to have a creditor’s statutory demand set aside on the basis that there is a genuine dispute and an offsetting claim;
- Assisting clients to compel customers to honour their obligations under a service agreement and commencing and resolving proceedings for subsequent breaches;
- Obtaining freezing orders against directors, employees and franchisees who have misappropriated monies;
- Applying for declaratory orders on behalf of an equitable mortgagee to the effect that its mortgage is accorded priority as the first in time against other mortgages;
- Acting on behalf of shareholders to effect the sale of their shareholding to an International company;
- Advising clients on the effect of the Bamford decision and the need to amend Trust Deeds;
- Applying for orders on behalf of a landowner to take immediate possession of a sandstone mine as a result of the tenants failure to renew its lease or vacate the mine. The matter also involved seeking damages against the tenant for its failure to cease conducting mining activities after the lease had been terminated;
- Acting on behalf of a mother to seek declarations that she is part owner of a house with her daughter;
- Leading advisor on aggregation of business for public companies.
