Simone has acted in a broad range of matters including debt recovery for public and private companies and various organisations, building and construction disputes, general contractual disputes, freezing orders, general declaratory relief, insolvency, winding up and bankruptcy actions. Simone is able to represent clients in all court jurisdictions and QCAT.
She also provides commercial advice and assists in the negotiation of disputes in pre-litigation dealings.
Simone has represented a broad range of clients including listed and private companies, small businesses, local Councils, insolvency practitioners and individuals involved in litigation.
Recent Matters
- Assisting a local Council to recover outstanding rates and other charges from property owners;
- Pursuing and defending contract disputes;
- Pursuing a local Council for negligence and misleading and deceptive conduct on behalf of a land owner;
- Acting on behalf of a mother to seek declarations that she is part owner of a house with her daughter;
- Defending a prolongation and quantum meriut claim by a subcontractor against a property developer;
- Defending a number of inter-related companies and their directors against a claim by a mortgagor for breach of a mortgage and acceleration of mortgages claim;
- Resisting an enforcement warrant for sale and seizure of property by a mortgagor;
- Acting on behalf of a consumer against a manufacturer for breach of contract, misleading and deceptive conduct and faulty goods;
- Issuing creditor’s statutory demands and winding up companies for non-compliance with a statutory demand;
- Applying to have a creditor’s statutory demand set aside on the basis that it does not comply with the Corporations Act 2001;
- Assisting clients to compel customers to honour their obligations under a service agreement and commencing and resolving proceedings for subsequent breaches;
- Obtaining freezing orders against employees and franchisees who have misappropriated monies;
- Pursuing and defending building disputes in the Queensland Civil and Administrative Tribunal;
- Pursuing and defending claims made pursuant to the Building and Construction Industry Payments Act 2004;
- Acting on behalf of a local Council to seek a declaration that it had complied with the applicable requirements under the Local Government Act 1993 relating to the sale of properties the subject of judgments and opposing an application as to the proper construction of section 1040(2) of the Local Government Act 1993;
- Acting on behalf of a construction company to apply to have an adjudication decision made pursuant to the Building and Construction Industry Payments Act 2004 set aside on the basis that the adjudicator had made a determination on a ground raised by neither party.
